How to Choose a Personal Injury Lawyer in Ontario
July 25, 2026
If you have been hurt in an accident, the lawyer you choose will shape how your claim unfolds — how quickly it moves, how well you understand it, and what you ultimately recover. Not every firm is the right fit for every case. Here is how to choose well.
Look for focused experience
Personal injury is its own discipline. A lawyer who handles injury claims day in and day out will know the insurers, the medical experts, and the settlement ranges for cases like yours. Ask how much of their practice is personal injury, and whether they have handled cases similar to yours — motor vehicle, slip and fall, workplace, or long-term disability.
Understand how fees work
Most personal injury lawyers in Ontario work on a contingency fee — they are paid a percentage only if you win or settle. Before you sign, make sure you understand:
- The exact percentage, and whether it changes if the case goes to trial
- Who covers disbursements (expert reports, filing fees) if the case is unsuccessful
- How and when you will be updated on costs
A good firm puts all of this in writing and walks you through it plainly.
Questions worth asking
- Who will actually handle my file day to day?
- How will you keep me updated, and how quickly do you return calls?
- What is a realistic timeline and range of outcomes for a case like mine?
- Have you taken cases to trial, or do you always settle?
Red flags
Be cautious of any lawyer who guarantees a specific dollar amount, pressures you to sign immediately, or is vague about fees. Trust and clear communication matter as much as credentials — you may be working together for a year or more.
